BIEM Webinar in April 2012 on Belgium and Danish legal decisions on  ISPs Liabilities

Two important court decisions have been taken regarding the role of ISPs and the possibility of imposing certain measures.

The first one, in Belgium in the Netlog case (which is closely connected to the earlier Scarlet case), rejected the obligation for the Internet platforms to filter and block all the works hosted on them without authorization,  but acknowledged the right to rights owners to be  able to force hosting platforms to take measures in order to fight against counterfeiting.

The second decision proceeded from a Danish city court which granted the Danish Rights Alliance, including KODA,  an injunction against a Danish ISP to prevent its customers from accessing grooveshark.com. This decision is one step in a overall strategy towards a better protection and remuneration of rights owners.

Jakob Hüttel (KODA Head of Legal and International Affairs) and Wim Germompré (SABAM in-house Legal Commercial Lawyer) present the pros and the cons of two decisions and the steps to be taken next.
